California Ends Robotaxi Citation Immunity: AV Manufacturers Get the Ticket Starting July 1

For years, a San Bruno police sergeant could watch a robotaxi execute an illegal U-turn directly in front of him and do nothing. There was no driver. Traffic law had no mechanism to assign liability to a machine. That gap closes July 1.

California’s Department of Motor Vehicles formally adopted new autonomous vehicle regulations on April 28, 2026 — the most comprehensive AV framework in the US to date. The rules cover citation authority, emergency response requirements, geofencing, incident reporting, and a new pathway for heavy-duty autonomous trucks on California roads.

The Citation Mechanism

When a driverless vehicle commits a moving violation, law enforcement can now issue a “Notice of AV Noncompliance” directly to the manufacturer or operator. The notice functions as a formal citation tied to the company, not a phantom driver.

Repeated or severe violations escalate. The DMV can impose targeted operational restrictions — fleet size caps, geographic limits, speed or weather conditions — and move to restrict, suspend, or revoke a company’s California operating permit. California is the largest auto market in the US. Losing the right to operate there is an existential consequence.

Incident reporting is tight: standard incidents within 72 hours. Serious incidents or those flagged for priority review: 24 hours.

Emergency Response

First responders have been dealing with AV friction since commercial robotaxi operations began. The new rules codify hard requirements:

  • AV operators must respond to first responder contact within 30 seconds
  • Emergency officials can issue electronic geofencing directives to clear AVs from active emergency zones
  • Companies must comply — directing their fleets out of the restricted area — within two minutes of notification
  • Every AV must include manual override access and two-way voice communication

The Waymo statement on the new rules: reviewing them and appreciates the opportunity to participate in informing the approach.

Heavy-Duty AVs Cleared for California

The regulations lift the prior ban on autonomous vehicles over 10,001 lbs GVWR. Autonomous freight operations are now permitted on California roads for the first time — but the testing threshold is steep. Heavy-duty AV operators must complete 500,000 miles at each testing phase before applying for commercial deployment. Light-duty: 50,000 miles. Both require a human safety driver phase before progressing to driverless testing.

Aurora, which has been running self-driving trucks in Texas since last year: “We are encouraged to see a regulatory path being established for autonomous freight in California.”

What Changes on July 1

California has spent years building a paradoxical situation where the world’s most active robotaxi deployments operated without basic traffic law accountability. The practical consequence was documented: the San Bruno incident in September 2025 where officers could not cite an AV that violated traffic law in front of them.

The citation framework solves one part of that. A fine issued to a well-capitalised AV company may not directly deter behaviour, as Carnegie Mellon’s Phil Koopman has noted — the accountability value is in creating a public data record of violations that regulators can act on. Permit restrictions and suspensions are the actual enforcement teeth.

For Tesla, which is scaling its Robotaxi programme and has designs on California, the July 1 date means every traffic infraction made by an autonomous vehicle is now formally logged and attributed.

The state has also established structured testing milestones as a condition of commercial permits — 50,000 and 500,000 miles at each phase — creating documented hurdles that regulators can use if a company tries to deploy faster than its safety data supports.

Several provisions took immediate effect on April 28. The citation authority and emergency geofencing requirements phase in on July 1.
