Anthropic quietly updated its privacy policy on June 8, 2026. The update takes effect July 8. The practical result: the company now has the legal authority to require consumer Claude users to scan a government-issued photo ID, take a live selfie, and submit facial geometry data before accessing certain features.

The policy change has gone largely unnoticed outside privacy circles. It deserves more attention, for two reasons: the data it authorizes Anthropic to collect is substantial, and the timing — two weeks after the Fable 5 export-control suspension — suggests it may have a second purpose beyond age verification.

What Gets Collected

Under the updated policy’s new “Verification Data” section, Anthropic may collect:

• An image of a government-issued identity document and the information on it (ID number, date of birth)
• A photo, video, or live selfie of the user’s face
• Facial geometry templates — which Anthropic acknowledges may constitute biometric data in some jurisdictions
• The result of the verification check (age threshold, nationality)

The policy does not specify what triggers an identity check. Anthropic’s support documentation says checks may occur “when accessing certain capabilities, during platform integrity checks, or for safety and compliance reasons.” The omission is deliberate: the company is not committing to a trigger list that would become a compliance target in different jurisdictions.

The Persona Factor

Identity verification is handled by Persona, a Founders Fund-backed identity infrastructure company. Persona acts as a data processor; Anthropic acts as the data controller.

The vendor relationship has provoked criticism. Founders Fund is also an investor in Anthropic, creating a related-party dynamic between Anthropic and its chosen biometric vendor. Anthropic is contractually Persona’s data controller, meaning it bears responsibility for how that data is used — including retention periods that the support documentation does not specify.

ID and selfie images are stored on Persona’s systems, not Anthropic’s. Anthropic retains access to verification records through Persona’s platform during appeals. The data is encrypted in transit and at rest, is not used to train models, and is not shared for marketing.

Compliance and Consequences

The policy applies only to consumer accounts: Claude Free, Pro, and Max plans. Claude Team, Enterprise, API, and commercial agreements under separate contracts are excluded.

Verification is described as voluntary in the current policy language. If a user chooses to verify, data is collected. What happens if they do not is unspecified. That omission may reflect legal uncertainty: more than two dozen US state digital safety laws now address age assurance for AI chatbots, and consequences of non-compliance vary by jurisdiction — from safety filter application to access denial.

The Fable 5 Connection

The policy was published June 8. Fable 5 and Mythos 5 were suspended globally on June 12, four days later, after a US government export-control directive. Anthropic’s statement at the time said the company “must abruptly disable Fable 5 and Mythos 5 for all our customers to ensure compliance,” citing an inability to distinguish between foreign nationals and US citizens in its user base.

The ID verification mechanism resolves exactly that problem for consumer accounts. A verified US passport or enhanced driver’s license confirms US citizenship. Anthropic now has a policy instrument to distinguish US nationals from foreign users — which would give it the option of restoring Fable 5 access for consumers willing to submit government ID, without violating the export-control order.

Prediction markets on Kalshi currently price a 58% probability that Anthropic restores Fable 5 access to US customers by July 1. The policy’s effective date of July 8 sits one week past that window.
